In august 2006, responding to FDA’s appeal, 10th U.S. Court of Appeals ruled in favor of FDA legalizing the ban on all ephedra supplements. The war between ephedra supplements manufacturing companies and FDA is not over yet! Although in October 2006, Nutraceutical Corporation filed a petition for rehearing citing too rigid format of the term “unreasonable risk” by FDA, court declined to take the case for rehearing.
It seems that this ban is going to stay forever with US Congress is incline to rewrite the laws that would award more powers to FDA and take required action to implement such bans.
