Ephedra weight loss supplements or ephedra for sale has been the topic of hot debate for last 7-8 years as the their legality parameters kept changing continuously. This has left numerous consumers in quite a confused state. Dieters in the quest of losing weight quickly using ephedra consumption as their weight loss means are now have to rely totally on the marketers.
2004 Ban
While some weight loss product marketers are telling ephedra products as illegal and thus replacing these products with product that contain psudoephadrine or ephadrine like ingredients with some exaggerated promises of great and quick weight loss ephedra was capable of! The reason behind this confusion among customers can be traced back to the ruling in 2004 by which FDA had imposed ban on all ephedra dietary supplements that are used for sports performance and in weight loss. FDA had declared that ephedra for sale is illegal and its consumption is harmful and fatal.
Utah Judgement
Soon after the 2004 ban by FDA, a company named Nutraceutical Corporation came forward in early 2005 to challenge the legality of imposed ban by FDA and raised questions about the legality and evidences that supported FDA’s ephedra for sale ban. The questions were raised about the authenticity of claims that ephedra alkloids consumption of less than 10 msg can prove fatal. Here, you should understand that prior to 2004 ban, most of the manufactures used to have 20 to 25 mg of ephadrine alkloids in their weight loss products.
As the Utah judge ruled in favor of Nutraceutical Corporation, many manufacturers started to market the ephedra products with new formulation that contained less than 10 mg of ephedra. However, during this time also, FDA’s stance was same saying ephedra products were illegal and dangerous. In fact, FDA took the help of US marshalls and raided numerous companies and laboratories to seize large amount of weight loss supplements containing ephedra.
Final Blow to Ephedra containing supplements
In august 2006, responding to FDA’s appeal, 10th U.S. Court of Appeals ruled in favor of FDA legalizing the ban on all ephedra supplements. After this, not only ephedra for sale is considered illegal but its marketing too became subject to disciplinary action. The war between ephedra supplements manufacturing companies and FDA is not over yet! Although in October 2006, Nutraceutical Corporation filed a petition for rehearing citing too rigid format of the term “unreasonable risk” by FDA, court declined to take the case for rehearing.
It seems that this ban is going to stay forever with US Congress is incline to rewrite the laws that would award more powers to FDA and take required action to implement such bans.
For long time, numerous people used ephedra supplements to lose weight quickly and effective. Despite the ban, many users are still searching for products containing ephedra as they firmly believe in power of ephedra in weight loss process.
